  • Contested versus uncontested divorce: The differences

    As an uncontested divorce lawyer in Illinois counties of Cook, Lake, DuPage, Will, and others, often people call me asking “What is the difference between contested and uncontested divorce?” If you want an affordable and fast divorce, it is crucial that you understand the answer to that question.

    There are two types of divorce available in most states: contested and uncontested divorce.

    Contested Divorce

    In a contested divorce the spouses don’t agree, and instead, litigate. Contested divorce is fairly commonplace, though many contested cases settle without a trial.  There are various hot-button issues in contested divorce:

    • child custody
    • child support
    • property division
    • asset distribution
    • debt allocation
    • alimony
    • temporary spousal support

    Uncontested Divorce

    An uncontested divorce is sometimes referred to as an “amicable” or “no-fault” divorce .

    In truth, spouses need not be amicable in an uncontested divorce. They can even hate each other. They just need to agree on all the issues involving divorce.

    In contrast to a contested divorce that can take years to complete, an uncontested divorce can be very quick. Some of my have taken less than one month.

    Most married people who want to get divorced probably would prefer uncontested divorce because of its speed, simplicity, convenience, privacy, and inexpensiveness. The efficiency and cost savings of uncontested divorces are the major advantages highlighted by most divorcing couples.

    As a Chicago divorce lawyer, I often run into people who are wondering how to tell their husbands and wives they want a divorce in Illinois.     You can’t do anything right

    If you feel you are never right in your marriage, it doesn’t really matter if you are right or wrong. The situation is unsustainable.

    Sex is virtually totally unappealing

    Some people think divorce is wrong, because of religious reasons. Others stay together for the kids. But if sex is totally unappealing to you, you might get sick of living as roommates. If that’s the case, divorce might be an option to explore.

    Love has been replaced by resentment

    Feelings of resentment come from being hurt by your spouse.  There is nothing wrong with feeling hurt by the actions of another. A marriage dies when spouses harbor hurt feelings and do nothing about them – that’s when resentment builds. From resentment grows bitterness and hostility, feelings hard to work through and more than likely mean the end of a marriage.

  • What is an Online Divorce?

    I see a lot of Google ads for something called an “online divorce.” And as a Chicago divorce lawyer you can contact here, I sometimes get inquiries from people asking me how to get an online divorce. I guess they want one because they think it is the cheapest way to get a divorce in Illinois.

    Here’s the problem – there is no such thing as an online divorce. This is true whether you want a divorce in Chicago, Evanston, Naperville, Schaumburg, Joliet, or anywhere else in Illinois.

    Those companies that purpose to offer online divorces do nothing more than ask you a few questions, feed your answers into a form, then spit out some paperwork. You never talk to a lawyer. That’s a dangerous way to get a divorce.

    Do I need a lawyer to get divorced?

    The answer is no. But then again, you don’t really need a pilot to fly a plane – if you like living on the wild side. Look, no one wants to spend money  to pay anyone to do anything. That’s common sense. But if you use a so-called “online divorce” company to help you prepare paperwork so that you can represent yourself in a divorce, you could be doing something that will negatively impact you for year to come.

    Have you ever done a brake job on a car? No? Well next time your brakes squeak, do yourself a favor and take the car to a mechanic. Next time you need a divorce, find a divorce lawyer.

    Even when highly intelligent clients tell me that they have worked out everything with their spouses, it never fails that upon further prompting from me, they learn that they have not actually discussed all relevant issues with their spouse.
