    If there’s one question I get more than most others, it’s “How long does it take to get divorced in Illinois?”

    What’s the quickest way I could get divorced?

    This site is clearly about uncontested divorce in Illinois. What’s that? It’s when parties agree to all aspects of their divorce: money, kids, debt – all that.

    How fast an uncontested divorce moves in based on the people involved, and the court in the county of the divorce. It’s possible for an uncontested divorce to take as little as two and a half weeks. Or maybe it will take more than a month.

    But to truly understand the fantastic speed of an uncontested divorce, you should consider what happens if your divorce is NOT uncontested. That is, what happens when parties fight in court.

    What steps are there in a litigious divorce?

    How long your divorce takes depends primarily on how much fighting you do with the other party. In divorce court, certain procedures must be followed. Consider the following  limited list of what my occur in a contested divorce:

    • Time to respond:Whenever someone files something in court, the other party gets to respond. The other party can have 21 days or more to respond.
    • Discovery: Discovery is the process of gathering evidence. Sending out subpoenas, doing depositions, etc.  Discovery can be expensive, and time-consuming. It can take a year to wade through complex finances.
    • Filing motions: Motions are how parties as the court to do one thing or the other. Each time a motion is filed, the other party can respond, and a chain reaction occurs.
    • Court’s schedule: Courts are busy. A hearing or trial might be scheduled for more than two moths away.
    • Other matters: If one party is not following court orders, that could also cause a delay.

    How to move forward

    I handle uncontested and contested divorces. If someone wants to pay me to fight their case, I can do that. But I often try to steer people towards coming to an agreement and getting an amicable and quick divorce.     DuPage County may be the quickest county in Illinois in which to get a divorce.

    The DuPage County circuit clerk staff is very helpful, and they allow lawyers to file cases online – speeding up the entire process. Then after everything is filed, I move quickly to schedule a prove up date with the court – that’s where the divorce is finalized.

    That’s how I was recently able to complete a divorce there in less than one month.

    Getting divorced in Kendall County can be easy, and affordable. With the system I used, when you file for an uncontested divorce in Kendall County you only have to go to court once – at the end.

    There are several types of costs involved in an uncontested case.

    • Lawyer’s fee: I offer flat fees for uncontested divorces. 
    • Court filing fee: There is a fee to file the case, and a fee for the other party to respond. At the time of the writing of this article, the total fee or both parties was $346.
    • Transcript fee: the court requires that a transcript be produced of the prove-up for a divorce (the appearance in court where the divorce is finalized). The last time I handled a Kendall county divorce, the transcript fee was $60.

  • What is an Online Divorce?

    I see a lot of Google ads for something called an “online divorce.” And as a Chicago divorce lawyer you can contact here, I sometimes get inquiries from people asking me how to get an online divorce. I guess they want one because they think it is the cheapest way to get a divorce in Illinois.

    Here’s the problem – there is no such thing as an online divorce. This is true whether you want a divorce in Chicago, Evanston, Naperville, Schaumburg, Joliet, or anywhere else in Illinois.

    Those companies that purpose to offer online divorces do nothing more than ask you a few questions, feed your answers into a form, then spit out some paperwork. You never talk to a lawyer. That’s a dangerous way to get a divorce.

    Do I need a lawyer to get divorced?

    The answer is no. But then again, you don’t really need a pilot to fly a plane – if you like living on the wild side. Look, no one wants to spend money  to pay anyone to do anything. That’s common sense. But if you use a so-called “online divorce” company to help you prepare paperwork so that you can represent yourself in a divorce, you could be doing something that will negatively impact you for year to come.

    Have you ever done a brake job on a car? No? Well next time your brakes squeak, do yourself a favor and take the car to a mechanic. Next time you need a divorce, find a divorce lawyer.

    Even when highly intelligent clients tell me that they have worked out everything with their spouses, it never fails that upon further prompting from me, they learn that they have not actually discussed all relevant issues with their spouse.
